Masimo: A Stubborn Corp That's Spent $100M to Beat Apple

Apple’s latest smartwatch sales are briefly paused after Christmas, only to resume them with a fresh court order later on, until a final decision is taken by the US Customs office.

While it’s seemingly a court win for Apple, the company is far from being done with the allegation. Masimo, a health tech firm suing Apple, says it should pursue this case to make “more impact on the world“, which has already spent over $100 million and is ready to pour in more.

Holding the World’s Biggest Company

Taking on Apple is never a small deal, as it has a lot of resources at it’s disposal, making it harder even for the established companies to go against it. Yet, a simple health technology company called Masimo is ready to beat it, as noted by it’s CEO.

In an interview with The Wall Street Journal, Masimo CEO Joe Kiani explains why he’s determined to fight Apple until the end: “No one is standing up to them. If I can do it, it might change Apple for the better”.

Starting in January 2022, Masimo has already spent around $100 million fighting Apple and is ready to pour in more. While it’s unknown when the case will wind up, Masimo is determined to take it till the end, as it did in the past.

In 2006, Masimo won a seven-year patent war against Nellcor, earning $800 million in damages and royalties. In 2016, Masimo beat Philips in a patent-infringement case, earning $300 million and a licensing deal that generated “more than $1 billion” for the company.

Hoping to deal with Apple in the same way, Kiani says that the Cupertino company has yet to partake in “serious discussions about a settlement” with Masimo. Furthermore,

“I feel like I have to do this. If I can change the most powerful company in the world from continuing to act badly, that’ll have more impact on the world than anything else I’m doing.”
